These Terms of Service ("Terms") govern your access to and use of the Point of Sale (POS) and Inventory Management software provided by DevSpace Systems ("we", "us", or "our"). By accessing or using the software, you agree to be bound by these Terms.
Subject to your payment of the applicable setup fees, we grant you a non-transferable, non-exclusive license to use the DevSpace POS software for your internal business operations. You may not:
You are responsible for safeguarding the passwords and accounts you use to access the software. You agree to notify us immediately of any unauthorized access to or use of your accounts. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.
Our software is provided on a one-time setup fee basis unless otherwise specified. Any additional custom modules, advanced hardware, or subsequent years of web hosting (if applicable) may incur additional charges as outlined in your initial invoice and agreement.
You retain full ownership of all business data, inventory records, and customer information you input into the POS system. While the software provides backup functionalities, you are solely responsible for routinely exporting and securing backups of your data. We are not responsible for accidental data loss caused by user error or hardware failure.
To the maximum extent permitted by law, DevSpace Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the software.
We may modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of this page. Your continued use of the software after any modifications constitutes your acceptance of the revised Terms.
